Google is said to be the biggest regulatory challenge to date for its lucrative digital advertising business, scrutinized by EU antitrust regulators at the end of the year.
Google’s dominance in online search and its role as a gatekeeper to the rest of the internet are already the focus of antitrust investigation and complaints in several countries. A new EU probe could change the focus of such cases to YouTube and Google’s other online platforms.
The EU competition enforcer – the European Commission – is examining Google’s market behavior in the areas of online display advertising, online shopping and Google Play, the company’s app store. The regulator is looking at how Google promotes its own shopping and search services over rivals.
Google’s use of its clout as a gatekeeper to the web to make its own products more appealing to consumers is already causing regulatory problems in Europe. Authorities in the U.K. have brought charges against YouTube in two related cases – one involving YouTube’s “Google Preferred” ads.
The latest EU investigation focuses on ways Google distorts the market to benefit its own services. EU officials are probing Google’s behavior in relation to search, including how it uses information it gets from its Android mobile operating system to promote its own products.
“It is Google’s market position that they want to use, their use of that position and in that sense, we are dealing with their abuse of that position,” said one senior EU official, who spoke on condition of anonymity in order to speak freely about the investigation.
“How is Google abusing its position to get an unfair benefit, such as by manipulating search results?” asked the official. “The answer is: it’s doing so by the way it is shaping the market for search and content.”
The official added that the probe includes Google Play and how that company distorts the market for applications in its store.
BRUSSELS, June 18 (Reuters) - Alphabet (GOOGL.O) unit Google may face its biggest regulatory threat, with EU antitrust regulators set to open a formal investigation into its lucrative digital advertising business later this year. Matter.Europe, a Brussels-based campaign group that represents consumers, has warned it could launch the probe over allegations the company has abused its dominant market position and stifled competitors. EU competition regulators opened a review in 2014 into the way Google sells display adverts online, in the wake of allegations its comparison shopping service AdWords discriminated against other advertisers. Google, however, managed to persuade EU authorities that a formal investigation was not necessary. But Matter.Europe said it would not be the same in the case of Google’s digital advertising business, which accounts for more than a third of its revenue and the lion’s share of its profits. This is also when the digital ad business faces its biggest growth potential. That gives Google an incentive to slow the investigation and force a resolution that will minimise the potential damage to its business. The group said in a statement it was not ruling out any of the five formal options that the EU could adopt in its investigation, adding it “will consider any such remedies proportionate”. The probe is expected to last two years.
